Participants' Topics

NOTE: Topics will be subject to rephrasing. In some instances they will have been modestly modified by the instructor. Topics typically do not represent a "title" for the paper to follow. -- N.J.

Name Topic Date
Ford, Patrick The ethical rules that define and proscribe the unauthorized practice of law impose an unnecessary obstacle to the efficient administration of justice and should, in limited circumstances, be amended so that personal injury plaintiffs' lawyers can provide more efficient representation to their clients. Sept. 6
Learned, Chad Compare and contrast the intricacies of reciprocity between Japan, China and the US.  A Road Map to the Reciprocity Jungle.
McNeill, Timothy By understanding the ethical concerns as well as the benificial uses of self-help legal software, law firms may be able to employ it as a means of developing new business. Sept. 23
Moore, David

The problems of poorer parents and children with disabilites covered under the IDEA in obtaining legal assistance and proper placement for a free and appropriate public education can be solved through or by 1. voluntary mediation hearings
conducted by attorneys trained in mediation techniques and knowledgable in special education law to ensure a proper placement, and 2. altering the fee shifting provision to include IEP meetings.
Sept. 6

Quick, Gary The problems of decreasing affordable access to legal assistance, lack of experiential training, and low public perception of lawyers can be improved by instituting a legal residency training program as an additional requirement for admission to the bar.  Sept. 15
Rawe, Jennifer The problem of small numbers of women who make partner in private practice, primarily because they chose to have children, can be resolved in part by detailing the persuasive reasons for and benefits of making women partners. Sept. 6
Roach, Benjamin When individual law firms containing pre-paid legal service client bases encounter dual representation conflicts of interest, the solution is planning through contractual designation of an independant law firm.  Sept. 6
Sissel, Scott Due to the lack of real world experience by law school graduates, the high cost of basic legal services, as well as the free time that some law students have, the employment of law students by a few practicing attorneys who solely supervise them would greatly influence and decrease all three of these problems. Sept. 20
